These Terms of Service (“Terms”) govern your use of agsprotect.com (the “Site”) operated by AGS Protect, Inc. (“AGS,” “we,” “us,” “our”). If you don't agree to these Terms, please don't use the Site.
Not a services contract. These Terms cover the website only. Any security services you purchase are provided under a separate written agreement (proposal, SOW, MSA) that controls in case of conflict. Using the Site or submitting a form does not create a contract, quote, or obligation.
1) Informational Use Only
All content on the Site—text, images, downloads, and examples—is for general information and marketing. It may not reflect the latest configurations, availability, or pricing. We may change or remove content at any time without notice. Nothing on the Site is professional advice.
2) No Warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, or accuracy). We don't warrant that the Site will be uninterrupted, timely, secure, or error-free.
3) Limitation of Liability
To the fullest extent permitted by law, AGS and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, arising from or related to your use of (or inability to use) the Site, even if advised of the possibility. Our total liability for direct damages shall not exceed $100.
4) Your Use of the Site
You agree not to misuse the Site—e.g., no attempting to access non-public systems, probing for vulnerabilities, scraping without permission, introducing malware, or using the Site in violation of applicable laws. We may suspend or restrict access for suspected abuse.
5) Submissions & No Obligation
When you submit a form or email (e.g., quote requests, RFPs), you give us permission to use that information to respond and prepare proposals. Submission does not obligate either party to proceed. Any resulting statements of work or agreements must be in writing and signed by both parties.
6) Intellectual Property
The Site and its original content, features, and functionality are owned by or licensed to AGS and are protected by copyright, trademark, and other laws. You may not copy, modify, create derivative works, or redistribute Site content without written permission.
7) Third-Party Links
The Site may contain links to third-party websites. Those sites are not controlled by us; their terms and privacy policies apply there. We're not responsible for third-party content, services, or practices.
8) Privacy & Cookies
Your use of the Site is also subject to our Privacy Policy, which explains what we collect (e.g., contact form data, Google Analytics), how we use it, and your choices (including California rights). For privacy questions, contact info@agsprotect.com.
9) Changes to These Terms
We may update these Terms from time to time. The "Last updated" date shows the latest version. If changes are material, we'll take reasonable steps to notify you (e.g., updating this page). Your continued use of the Site after changes means you accept the revised Terms.
10) Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes relating to the Site shall be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
